Signing documents with contractors in SignSafe means sending contracts, work orders and protocols to people who have neither a qualified signature nor an account. Contractors, freelancers and small counterparties rarely hold a qualified signature and even more rarely want to create an account in yet another company’s system. Usually they want to sign quickly, on a phone, and get back to work. This can be handled so that it is simple on both sides.

Which signing method to choose when contractors have no qualified signature and will not register

Choose a method that requires nothing from the contractor beyond a phone and an email address. In SignSafe the contractor does not register or install an app. They receive an email with a link, open the document with a one-time code (no password), read it, tick the consent and sign with a finger. The whole thing takes about a minute.

Contractors in the field and at a service point: signing with no login

Not every contractor starts the day at an email inbox. For those situations there are two more ways: signing on a device standing at a service point, with no login and no account, and signing on a courier’s or delivery driver’s tablet. They suit acceptance protocols, delivery confirmations and small documents signed on the spot.

Several documents and several contractors at once

You can send a contract, a declaration and a protocol the same way, one after another or to many people at the same time. The sender chooses whether a signer gives one signature that is applied to all their places, or signs separately each time. Signatures can be in any order or in a fixed order: the next person receives the document after the previous one.

Someone who signs many documents selects them and signs them all at once. We do not state a limit on the number of documents. If the same contract goes to a contractor with different details, a template with fields to fill in is convenient.

Contractors abroad and in another language

A contractor without a PESEL number ticks “None” in the form and enters an identifier, for example an identity document number. The signer’s interface is available in Polish and English, and we can add any further language. It is worth having a contract with a foreign contractor in a language that person understands.

Limits: when another signature or a notarial deed is needed

This is a summary of opinions, not legal advice. For acts that require written form, a handwritten SignSafe signature is, according to the opinion, sufficient. Where the law requires the electronic form under Art. 78¹ of the Civil Code, a qualified electronic signature is needed, and then we can connect one in SignSafe. We do not compete with notarial deeds.

One system for customers, employees and contractors

Each group has different requirements, but the tool can be the same. A customer gets a link, an employee a template with fields, and a contractor a simple document to sign with a finger. A signature in SignSafe is a handwritten signature and, according to the legal opinion of the law firm Gałecki and Associates of 21 August 2023, meets the written form requirement (Art. 78 of the Polish Civil Code). This is a summary of an opinion, not legal advice.

It is not a qualified electronic signature. Where a qualified electronic signature is required, we can connect one in SignSafe. We do not compete with notarial deeds.

A signing record is attached to the signed document: sender details, plus each person’s name, email, IP address, device and time of signing.

Documents are stored on servers in the European Union (OVH hosting), and for business customers we conclude a data processing agreement.

A signature placed in SignSafe is a handwritten signature, and a declaration of intent signed in the app meets the requirements of written form. If the signature did not qualify as handwritten, the declaration is still valid in documentary form. In legal effect it is equivalent to a qualified electronic signature: both preserve written form.
